What is a “Tapu”?

The Tapu is an official and legal document proving ownership of a property. It is issued by the General Directorate of Land Registry and Cadastre (TKGM). In Turkey, the transfer of property ownership is only valid when it is officially registered and signed at the Land Registry Office.

Pre-Requisites: What Documents Do Foreigners Need?

Before applying for the title deed transfer, foreign buyers must gather specific documents. Having these ready will significantly speed up the process:

  • Tax Registration Number: You will need a Turkish Tax Number (Vergi Numarası), which can be easily obtained online or at a local tax office.
  • Passport and Translation: Your original passport and a notarized Turkish translation.
  • Appraisal Report (Değerleme Raporu): Foreigners are legally required to obtain a real estate valuation report by a CMB-approved (SPK) company to ensure the property is not being overvalued.
  • Foreign Exchange Purchase Certificate (Döviz Alım Belgesi): You must sell your foreign currency to the Central Bank of Turkey (usually via your local Turkish bank) in exchange for Turkish Lira. This certificate is mandatory for foreign buyers.
  • Biometric Photos: Recent passport-sized photos for the official records.

The Step-by-Step Title Deed Process

Step 1: Preliminary Checks and Agreement

Before any official application, ensure a thorough background check on the property. Your real estate agent will verify that the property has no outstanding debts, mortgages, or legal restrictions (Ipotek). Once cleared, a sales contract is signed between the buyer and the seller.

Step 2: Getting the Appraisal Report

An independent expert evaluates the property and prepares a detailed valuation report. This report is valid for three months and is submitted directly to the Land Registry system.

Step 3: WebTapu Application

The seller (or your authorized power of attorney) initiates the title deed transfer application via the online system called WebTapu. All necessary documents, including the Appraisal Report and the Foreign Exchange Certificate, are uploaded to the system.

Step 4: Paying the Title Deed Fees

Once the Land Registry Office reviews and approves the application, they will send an SMS with the exact date, time, and the required fees for the final signatures. The standard title deed conveyance tax is 4% of the declared property value, usually split equally between the buyer and the seller, plus a circulating capital fee (Döner Sermaye).

Step 5: Final Signatures at the Land Registry Office

Both the buyer and seller (or their legal representatives) must be present at the Land Registry Office at the appointed time. Important note: If you do not speak fluent Turkish, it is legally mandatory to have a sworn translator present to ensure you fully understand the transaction. Once the signatures are complete, you will be handed your original Tapu!
